On December 7, hosted by the Beijing Lawyers Association and organized by the Criminal Procedure Law Specialized Committee of the Beijing Lawyers Association, Specialized Training: "Basic Skills in Criminal Defense—Evidence Review and Cross-Examination in Criminal Defense" Successfully held in Beijing, this training is designed to help lawyers in the capital adapt to the increasingly sophisticated development trend of evidence rules and strengthen their professional skills in criminal defense. During the special presentation session, Director Wang Jun delivered an in-depth lecture on the topic of “The Application of Electronic Data in Criminal Defense,” drawing on her extensive practical experience. She pointed out that, against the backdrop of information technology profoundly transforming social life and criminal patterns, electronic data has become a key type of evidence in criminal cases, and the ability to effectively review and utilize such data is directly linked to the quality and effectiveness of defense work.
Director Wang Jun’s presentation was both systematic and practical. She began by outlining the legal definition of electronic data, its various forms of presentation, and the relevant regulatory framework, thereby clarifying the basic framework for its use in criminal proceedings. She then focused on comparing the strategic differences between the prosecution and the defense in their use of electronic data: while the prosecution emphasizes the standardization of collection and extraction procedures as well as the establishment of a complete chain of evidence, the defense must concentrate on carefully scrutinizing the legality of the evidence-gathering process, the authenticity of the data, and its integrity. And is skilled at using specialized tools such as hash value verification, along with technical methods like file attributes, to detect potential issues.
By citing several typical criminal cases, Director Wang Jun vividly demonstrated how, in cases involving the infringement of citizens’ personal information and the illegal acquisition of data from computer information systems, How to effectively identify evidentiary flaws by conducting professional cross-examination on electronic data exhibits from dimensions such as authenticity, legality, and relevance. Thus, a strong defense argument is formed. She also briefly introduced the supporting role of big data analytics in defense and outlined practical approaches for initiating procedures to exclude illegally obtained evidence in response to unlawful evidence-gathering practices.
