June 13, The 6th Practical Salon of Beijing Xinglai Law Firm was held as scheduled at Xinglai Law Office. The theme of this salon session is "Exploring the Basis of Claims in Civil Litigation Through Detailed Case Analysis." Led by Hua Jinzhi, Partner at Xinglai Law Firm and Director of the Civil & Commercial Business Center, By combining online and offline approaches, this event delivered a professional feast that deeply integrated theory with practice for legal professionals.

At the beginning of the event, Cheng Xiaolu, Chair of the Partner Meeting at Beijing Xinglai Law Firm, delivered the opening remarks. She emphasized that the Xinglai Practical Salon is not only a window to showcase the firm’s professional image but also a vital platform for the growth of Xinglai’s young lawyers. She encouraged the young lawyers to seize this opportunity, actively participate, and continuously enhance both their professional expertise and overall capabilities—skills essential for aligning with the firm’s strategic focus on providing comprehensive, one-stop solutions to complex criminal-civil-mixed legal challenges faced by businesses.

Subsequently, Drawing on her more than ten years of extensive experience handling civil cases, Attorney Jin Hua delivers a systematic explanation that explores both the theoretical depth and practical applications of her expertise. He pointed out that the basis of a claim is a crucial concept in civil law, holding significant theoretical and practical importance. In civil litigation, accurately identifying the basis of a claim is essential for achieving favorable litigation outcomes and increasing the likelihood of success. Whether as the plaintiff or defendant, understanding the basis of a claim helps parties better analyze and organize both factual and legal elements of the case, enabling them to craft effective litigation strategies.


During the expert analysis session, Attorney Jin first defined the legal source system underlying the right of claim, which includes statutes, administrative regulations, local rules, and judicial interpretations. He also specifically emphasized the differences in applicable rules between commercial arbitration and civil litigation. To deepen understanding, Attorney Jin organized an on-site seminar for lawyers, using a factory lease-to-redevelopment compensation case as a case study and encouraging multi-faceted discussions. During the session, the attending lawyers actively participated in discussions, exploring the basis of the claim from multiple angles—including contract law, torts, unjust enrichment, and customary practices.






Attorney Jin further guided everyone to consider how, when the basis for a claim cannot be directly identified, gaps in the law can be filled through methods such as legal interpretation, analogical application, and purposive expansion. He emphasized that the law will always have loopholes, and it is the responsibility of judges and lawyers—to work within the legal framework, employing sound interpretation and application techniques, to craft the most appropriate solution.

During the open discussion session, participants shared similar issues they’ve encountered in their casework, along with practical solutions drawn from their own experiences.
