On December 11, 2025, organized by the Criminal Procedure Law Specialized Committee of the Shenzhen Lawyers Association and hosted by Beijing CeLue (Shenzhen) Law Firm, “Criminal Litigation Business Exchange and Sharing Session” The event was held at the Shenzhen Pengcheng Hall. Attorney Wang Jun She delivered a special presentation on “The Application of Electronic Data in Criminal Defense.” Grounded in emerging trends in judicial practice in the digital era, she systematically reviewed the legal attributes, forms of presentation, and key review points of electronic data. Attorney Wang emphasized that, against the backdrop of increasingly stringent evidentiary rules, criminal defense lawyers should proactively embrace technological changes, strengthen their professional judgment on the integrity, authenticity, and relevance of electronic data, and—by standardizing evidence-gathering procedures, identifying data defects, and making effective use of technological tools—transform electronic data from an advantage held by the prosecution into a powerful support for the defense. Her presentation highlights the inevitable shift in criminal defense—from experience-driven practices toward technology-integrated approaches, providing practical guidance for enhancing the quality and effectiveness of defense strategies.

Attorney Lu Fang He elaborated on the topic “The Philosophy, System, and Techniques of Procedural Defense in Criminal Cases.” From a practical perspective, he summarized fourteen “standard procedures” for procedural defense—such as raising objections to jurisdiction, applying to exclude illegally obtained evidence, requesting the production of evidence, and requesting changes to coercive measures—and thoroughly analyzed the strategies and effectiveness of procedural defense by drawing on numerous successful cases he had handled. Attorney Lu pointed out that procedural defense serves three distinct functions: elementary, intermediate, and advanced. Beyond its traditional role in influencing substantive findings, procedural defense also safeguards the litigant’s procedural rights and helps regulate the pace of litigation. The independent value of procedural defense lies precisely in upholding procedural justice to ensure that every litigant enjoys the right to a fair trial. He called upon frontline criminal defense attorneys to master and skillfully apply procedural rules, persistently pursuing justice in each case, and using professionalism to drive forward the development of China’s criminal defense system. Finally, he looked ahead to the direction of legislative improvements regarding the jurisdiction system during the fourth amendment to the Criminal Procedure Law, and quoted the insightful remark by Professor Morikazu Taguchi of Waseda University in Japan—that “the history of criminal procedure is the history of the expansion of the right to defense”—to encourage his colleagues.

His argument highlights the strategic importance of procedural awareness, rights-based thinking, and ethical consciousness within an effective defense system.
